In order to implement the spirit of the Third Plenary Session of the 18th CPC Central Committee and the requirements of the State Council, further promote the decentralization of power, establish a power list system, give full play to the decisive role of market allocation resources, and stimulate the vitality of enterprises, especially small and micro enterprises. Approved, the relevant notices on matters relating to further strengthening the management of charge-related enterprises and reducing the burden on enterprises are as follows:

I. Establish and implement a list system for the list of enterprises involved in charging

Further improve the transparency of the enterprise-related charging policies, and implement directory inventory management for administrative and institutional fees, government funds, and operational service charges for implementing government pricing or guidance prices established in accordance with laws, administrative regulations, and relevant national policies. Continuously improve the publicity system. The list of all relevant enterprise-related charges and its specific implementation are included in the openness of government affairs in all regions and departments, and are publicly disclosed through the government website and public media in real time, and accept social supervision. All regions and departments must strictly implement the list of directories, and the fees charged by enterprises outside the list of directories shall not be enforced.

Second, strict examination and approval of enterprise-related administrative fees and government fund projects

From the date of issuance of this notice, the newly established enterprise-related administrative fees and government fund projects must be in accordance with the relevant laws and administrative regulations. For those who have no legal or administrative regulations but are required to establish according to international conventions or reciprocity principles, the Ministry of Finance shall review with the relevant departments and submit them to the State Council for approval. The finance, price and other departments at all levels must constantly improve the management of the fees charged by enterprises, strengthen the coordination of fee management and industrial policies, improve the fee billing and license management system, establish a multi-level supervision system, and further strengthen the supervision of the matter and afterwards.

Third, effectively standardize the administrative approval of pre-service items and charges

The administrative examination and approval pre-service items and charges shall be thoroughly cleaned up, and the administrative approval pre-service items without legal and regulatory basis shall be cancelled. All localities and departments shall disclose the administrative approval pre-service items related to fees and charges, and introduce a competition mechanism to adjust prices through the market. The government pricing catalogue management is implemented for individual administrative pre-services that require government pricing and government guidance prices. For the administrative approval pre-services listed in the government pricing catalogue, the service cost should be strictly verified and the service price should be established. Fourth, resolutely investigate and deal with various violations of the lawful rights and interests of enterprises

All relevant departments should strengthen coordination and resolutely stop all kinds of acts of arbitrary charges, fines and apportionment against enterprises, and cancel the administrative and institutional fees, government funds and administrative approval pre-operation service charges. It is strictly forbidden to raise the charging standards and expand the scope of fees without authorization. It is strictly forbidden to force enterprises to sponsor donations, order newspapers and periodicals, participate in training, join clubs, and designate services in various ways. It is strictly forbidden for industry associations and intermediary organizations to use administrative resources to charge fees. Once it was found to be resolutely exposed, it was in accordance with the "People's Republic of China Price Law", "Provisional Regulations on Prohibiting the Apportion to Enterprises", "Regulations on Punishment of Financial Violations", "Administrative Punishment Provisions on Price Violations" and other laws and regulations as well as the Party Central Committee and the State Council. The relevant provisions on the management of arbitrary charges are dealt with seriously, and the legal responsibilities of the relevant personnel are investigated. Establish a business burden survey information platform, improve reporting and feedback mechanisms, strengthen public opinion supervision, and increase investigation and punishment.

V. Comprehensively deepen the reform of the charging system for enterprises

In accordance with the principle of “regular tax payment”, we will further clean up, cancel, and standardize the current administrative and institutional fees and government fund projects involving enterprises, and gradually reduce the number of projects. Cancel the administrative fee-based project that the government provides universal public services or reflects the general management functions; combined with the adjustment of departmental functions, the relevant administrative fees and charges set up in different departments are merged. Cancel the government fund projects that are not obvious in policy effect and do not meet the requirements of the public finance system, and incorporate the tax fund projects with taxation nature into the corresponding tax categories according to law. Establish a long-term mechanism to support small and micro enterprises, comprehensively implement the various fee reduction and exemption measures that have been introduced, and temporarily change the management fees for small, micro enterprise management, registration, and licenses into long-term measures. Strengthen the publicity and evaluation of the enterprise-related charging policies, promote the establishment and implementation of third-party evaluation mechanisms, and effectively enhance the pertinence and timeliness of charging policies. Study and improve relevant laws and regulations to protect corporate rights and interests.

All regions and relevant departments must fully understand the importance of further strengthening the management of enterprise-related charges and alleviating the burden of enterprises, give full play to the role of all levels of work mechanisms for alleviating enterprises, strengthen organizational leadership, and do a good job of implementation. The Inter-Ministerial Joint Meeting of the State Council on Reducing Enterprise Burden is responsible for work guidance, organization, coordination, supervision and inspection throughout the country. The member units of the joint meeting shall, in accordance with the division of responsibilities, do a good job in implementing relevant policies.
